AGREEMENT TO TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you") and BizWiz Digital Agency ("BizWiz," "we," "us") governing your use of our services, including our Trial Pack, retainer engagements, and all related deliverables.

By purchasing any service or engaging BizWiz, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not purchase our services.

SERVICE DESCRIPTION

BizWiz Digital Agency provides digital marketing, brand strategy, creative design, and consulting services. Our primary offering includes:

The scope, deliverables, and timeline for each service are as described on our website and confirmed during the onboarding process.

CLIENT OBLIGATIONS

To ensure timely and effective delivery, you agree to:

• Complete the onboarding form within 24 hours of payment
• Provide accurate and complete business information, brand assets, and social media credentials
• Respond to communications within 24–48 hours to avoid delivery delays
• Grant necessary access to social media accounts, ad accounts, and analytics platforms

Delays caused by incomplete or untimely client responses may extend the delivery timeline beyond the stated 7-day period.

PAYMENT TERMS

• Trial Pack: Full payment of ₹1,999 (or international equivalent) is required upfront before work begins.
• Retainer Services: Billed monthly in advance, as agreed in the retainer proposal.
• Ad Spend: Any advertising spend (Meta, Google) is separate and paid directly to the advertising platform by the client.
• Payments are processed securely through Razorpay. We accept UPI, debit/credit cards, net banking, and international cards.
• All prices are inclusive of applicable taxes unless stated otherwise.

INTELLECTUAL PROPERTY

Work Product: Upon receipt of full payment, all custom deliverables created specifically for you become your property. You receive full usage rights for your business purposes.

BizWiz IP: Our proprietary frameworks, methodologies, templates, and strategic approaches remain BizWiz intellectual property. You may not resell, redistribute, or white-label our methodologies.

Portfolio Rights: We reserve the right to showcase work created for you in our portfolio and marketing — unless you explicitly request otherwise in writing.

CONFIDENTIALITY

Both parties agree to maintain confidentiality of proprietary business information shared during the engagement, including financials, trade secrets, marketing strategies, and customer data. This obligation survives termination of the service agreement.

LIMITATION OF LIABILITY

BizWiz provides strategic and creative services. We do not guarantee specific business outcomes, revenue figures, lead counts, or ROAS. Marketing results depend on factors beyond our control including market conditions, product quality, and client execution.

Our total liability shall not exceed the amount you paid for the specific service in question. In no event shall BizWiz be liable for indirect, incidental, consequential, or punitive damages.

TERMINATION

Either party may terminate a retainer engagement with 15 days' written notice. For the Trial Pack, once payment is made and the onboarding form is submitted, the engagement is active and non-cancellable (subject to our refund policy).

BizWiz reserves the right to terminate services immediately if the client engages in abusive, fraudulent, or unlawful behaviour.

GOVERNING LAW & DISPUTES

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ajmer, Rajasthan, India.

Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for 30 days.
